The Arbitrasia Council for Dispute Resolution (ACDR) advises all parties who wish to refer their dispute to the council for Arbitration to utilize the following arbitration clause in their contracts:
“Any dispute or difference whatsoever arising between the parties out of or relating to the construction, meaning, scope, operation or effect of this contract or the validity or the breach thereof shall be settled by arbitration in accordance with the Rules of Arbitrasia Council for Dispute Resolution (ACDR) and the award made in pursuance thereof shall be binding on the parties. The dispute shall be settled by ______arbitrator(s) and the seat of Arbitration will be at ____________.”
The parties should specify number of arbitrators and place of arbitration as per their agreement.
The Arbitrasia Council for Dispute Resolution (ACDR) advises all parties who wish to resolve their dispute through the process of conciliation under the rules of the council and desires to designate the ACDR as appointing authority and/or to provide administrative services may utilize the following standard clause in their contracts:
“If a dispute arises out of or in connection with this contract, or in respect of any defined legal relationship associated therewith or derived therefrom, the parties agree to seek an amicable settlement of that dispute by conciliation under the ACDR Rules of Conciliation. The authority to appoint the conciliator/conciliators shall be the Arbitrasia Council for Dispute Resolution (ACDR). ACDR will provide administrative service in accordance with the ACDR Rules of Conciliation”.
